As an authorized agent of

I/we are allowing Kat Ku ("Photographer") of Kat Ku Photography, LLC and her associates to photograph our adoptable animals, upon the terms herewith stated and in which no monetary or other compensation is due to me, my heirs, the Shelter/Rescue group, legal representatives and assigns, I hereby give to Kat Ku, her heirs, legal representatives and assigns, those for whom Kat Ku is acting, and those acting with her authority and permission to:

1. Photograph its adoptable animals as and when requested. Photographer is under no obligation to provide ongoing photographic services and Shelter/Rescue is under no obligation to exclusively use the services of Photographer.

2. All photographs created by Photographer (“the Images") are the intellectual property of Photographer and are protected by the United States of America international copyright laws. Shelter/Rescue acknowledges that other than the limited license rights set out below it has no rights to the Images and that all intellectual property rights, including copyright, belong to the Photographer at all times. Only Photographer, at her sole discretion, has the right to sell, print, display, modify, license and/or publish any of the Images in any media now known or to be invented for any legal purpose including advertising, promotion, marketing and packaging for any product or service, alone or combined with other images, text and graphics, and cropped, altered or modified for such purpose.

3. Photographer will deliver a reasonable number of professionally edited, low-resolution, watermarked digital files to the Shelter/Rescue (“Adoption Images”) within a reasonable time period following each photo session. Photographer hereby grants a license for the Shelter/Rescue to use the Adoption Images it receives from Photographer on their website and other internet marketing avenues for the purpose of promoting for adoption the pet featured in the Adoption Image. No images may be manipulated, cropped or otherwise altered, watermarks removed, resold, printed, or reprinted for any profit-making, commercial or advertising purpose without permission of photographer. Media requests for print-ready Images, and any other usage desired by Shelter/Rescue, are outside the scope of this license and such requests shall be referred to Photographer and addressed by separate agreement.

4. In exchange for photographing said adoptable pets, Kat Ku Photography asks that a credit line be provided, where possible, as follows if photos are printed in media: Photography © 2015 Kat Ku, ‪www.katkuphotography.com‬.

5. The Shelter/Rescue hereby relinquishes any right they may have to examine or approve the completed product or products or the advertising copy or printed matter that may be used in conjunction therewith or the use to which it may be applied.

6. The Shelter/Rescue hereby releases, discharges and agrees to save harmless Kat Ku, her heirs, legal representatives or assigns, and all persons functioning under her permission or authority, or those for whom she is functioning, from any liability by virtue of any alteration or use in composite form whether intentional or otherwise, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.

7. The agent(s) authorized to approve this for the Shelter/Rescue does hereby affirm that they are over the age of majority and have the right to contract in their own name on behalf of the shelter/rescue. They have read the above authorization, release and agreement, prior to its execution; they fully understand the contents thereof. This agreement shall be binding upon them and subsequent authorized agent(s), legal representatives and assigns.
